1. Registration Terms and Condition
Please read these terms and conditions carefully. These terms and conditions, and any other terms, conditions, notices, contained elsewhere on this application, govern your entry and use of this application.
By continuing to use and / or browse this application and / or any services on the application, you hereby acknowledge and agree to abide by these terms and conditions.
Changes to terms may occur from time to time and will be communicated to users with a notice period as described under Section 15.
This electronic application contains information and materials protected by Law issuing intellectual property rights, including, but not limited to, database rights, from the content and materials included in this application, such as graphics, illustrations, texts, and images, Software, digital downloads, audio and video clips, or any combination thereof or other materials. All materials, information and content mentioned in this section represent the exclusive property of the How App & Web and are protected by copyright, applicable databases, and other laws.
The services available on the application can be used within the framework of the applicable laws, terms and conditions, noting that not all services described in this application may be available at all times or in all regions. Your eligibility for any specific services is subject to the final decision and approval issued by the How App & Web.
As a user of this application, you agree to use the application only for lawful purposes and not to misuse this electronic application and/or engage in any conduct that is unlawful, harmful, or otherwise objectionable in any way; This includes, but is not limited to, defamation, harassment, threat, transmittingobscene or offensive content or offense that violates anyone else's rights under the law; Or any infringement or violation of any intellectual property, trademark, copyright, database or other applicable laws or any illegal purposes; Inflicting damage to or interfering with the operations of any other person's hardware and / or software by uploading, sending, or downloading viruses or any corrupt files in this regard; Transfer or disclose trade secrets or any other confidential material or information; Or directing or lifting any automated programs, malware, crawlers, or any other automatic process that may weaken this application or harm our programs or the site’s network or infrastructure. You also agree not to violate the intellectual property rights or any other rights of other people.
The How App & Web reserves the right to recourse to the person responsible for any damage caused to it as a result of misusing this application in the way previously or by using the application in any way that does not comply with the provisions of the laws, terms and conditions that are applicable.
If you use this application, you are responsible for maintaining the confidentiality of your account information and your password - if any - and for restricting access to your mobile device, and you agree to assume responsibility for all activities that occur under your account or password. The How App & Web reserves the right to refuse service and terminate or suspend the account. Confidentiality of the information: Regarding the obligation to confidentiality of information and data, the provisions of the laws in force in this regard shall be applied, in particular the Penal Code, the Personal Data Protection and the Tax Laws.
The How App & Web reserves the right to terminate or suspend your access to the application at any time, without notice, for conduct that the How App & Web believes violates these Terms and Conditions or is harmful to other users of the application, the How App & Web, or third parties, or for any other reason.
These terms and conditions shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising from or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Malaysia.
To the fullest extent permitted by applicable law, in no event will the How App & Web be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the application; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein;
(iii) any interruption or cessation of transmission to or from the application; (iv) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the application by any third party; or (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the application, whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not the How App & Web has been informed of the possibility of such damages.
By registering or subscribing to the services offered by How App & Web, you agree to a 12-month binding agreement. The subscription grants you access to the platform for 30 days each month, with automatic renewal at the end of each monthly period. No cancellation or refund requests will be entertained during this period.
All payments are final and non-refundable, regardless of usage or user satisfaction. Dissatisfaction with or limited use of the services does not exempt you from fulfilling your financial obligations under this agreement. This policy is implemented to ensure fair use and service continuity for all users. Access is provided for 30 days each month, and failure to use the service during this period does not entitle the user to a refund or credit for that month.
In the event of non-payment or default in payment of any fees, subscriptions, or outstanding charges due under this agreement, the How App & Web reserves the right to immediately suspend the user’s access to the portal and all related services without prior notice. Access to the portal will only be reinstated once all outstanding payments have been fully settled. During the suspension period, the user shall have no claim or entitlement to any service, access, or data until the account is brought into good standing.
Once a user has selected and subscribed to a specific plan, no downgrade or upgrade of the selected plan will be allowed during the 12-month binding period. Users who wish to change their plan must complete the current subscription term and subscribe to a new plan thereafter. All plan selections are final for the duration of the subscription and cannot be altered mid-term.
Each subscription plan is strictly associated with a single user account, identifiable by the registered email address or verified Google login. The subscription grants access to the How App & Web portal for a period of 12 months, and the registered email/login must remain unchanged during this period unless prior written notification and approval are obtained from the How App & Web. Users are strictly prohibited from reselling, sharing, or distributing access whether for profit or otherwise to the How App & Web portal or any of its services to unauthorized individuals. Any such actions will be considered a violation of these Terms and Conditions and may result in immediate termination of access without refund.
The How App & Web reserves the right to amend or update these Terms and Conditions at any time. Any such changes will be communicated to users via their registered email address, with a notice period of no less than thirty (30) days before the changes take effect. Continued use of the application after the notice period constitutes acceptance of the amended Terms and Conditions. Users who do not agree with the new terms must discontinue use before the changes take effect
Users will be notified via their registered email address at least 30 days prior to the expiry of their 12-month subscription contract. Upon expiry, users will have the option to select a new subscription plan that suits their current needs. The newly selected plan will be subject to a fresh 12-month binding period. If the user does not respond to the expiry notification within the stated period, the current plan will be automatically renewed for another 12-month term under the same terms and conditions. By subscribing, users agree to this auto-renewal policy unless cancellation or plan change is explicitly requested before the renewal date.
In the event that a subscription plan is discontinued, affected users will be notified via their registered email address with no less than thirty (30) days’ notice. Users must select an alternative plan from the currently available subscription options within the notice period. Failure to choose a new plan within the stated time may result in suspension of access until a new plan is selected and confirmed. The newly selected plan will commence a new 12-month binding period.
All subscription fees and charges stated by the How App & Web are exclusive of any applicable taxes, levies, or duties imposed by governmental authorities. Users are solely responsible for the payment of any such taxes or charges, including but not limited to sales tax, service tax, goods and services tax (GST), or other similar obligations that may apply in their jurisdiction.
The How App & Web provides the application and its services on an “as is” and “as available” basis, without any warranties of any kind, either express or implied. While we strive to maintain continuous, secure, and error-free access to our platform, we do not guarantee that the application will be uninterrupted, timely, secure, or error- free at all times. The How App & Web makes no warranties or representations regarding the accuracy, reliability, completeness, or timeliness of any content or services provided through the application. Users acknowledge that they use the application at their own discretion and risk, and that any business losses, damages, or disruptions arising from downtime, errors, or failures are not the responsibility of the How App & Web.
The How App & Web does not guarantee the accessibility, reliability, or uninterrupted functionality of any third-party applications, including but not limited to e.g., MyInvois or any other external service integrated with the platform. The use of such third-party applications is at the user’s own risk, and the How App & Web shall not be held liable for any issues, disruptions, or damages arising from the use of these third-party services.
All data uploaded by users to the How App & Web portal remains under the user's custody and control. The uploaded data is temporarily stored only during the active session. Once the user logs out of the application, all uploaded data is permanently deleted from the portal. The How App & Web does not retain, back up, or store any user-uploaded data after logout, and users are solely responsible for ensuring they have their own copies or backups if necessary. This policy applies solely to user-uploaded session data and batch file. Account registration details, such as email addresses, are retained as part of user account management.
The How App & Web aims to respond to all support requests within 48 business hours but does not guarantee any specific resolution time.
Users agree to indemnify, defend, and hold harmless The How App & Web, its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including attorneys’ fees) arising from their use of the application in violation of these Terms.
The How App & Web shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, or failures of suppliers, internet service providers, or third-party platforms.
The user is solely responsible for ensuring compliance with all applicable tax, invoicing, accounting, and regulatory requirements in their jurisdiction.
Users agree to comply with all applicable export laws and regulations, including restrictions on access by persons located in embargoed countries.
In the event that you violate the terms and conditions outlined in this User Agreement, your access to the services may be temporarily denied. During this period, you will not be able to use the platform or its features. This action is taken to ensure the integrity and safety of the platform.
If you believe this suspension has been applied in error or if you would like to discuss the matter further, please contact the administrator at [administrator contact email/phone]. Your case will be reviewed, and the necessary steps will be taken to address the issue.
Access will be reinstated once the review process is complete, and any violations are resolved.
You may be granted a promotional code that provides free access to the platform for a period of 30 days. This promotional code is a one-time use only and cannot be applied more than once per user.
The promotional code is non-transferable and cannot be sold, traded, or exchanged for any form of payment or profit, whether for personal or commercial use. Any attempt to transfer, sell, or misuse the promotional code will result in immediate termination of access, and you may be subject to further penalties or account suspension.
29. Session Time Limit and Re-Login Restriction
Each user is granted a maximum of 30 minutes per session, after which they will be automatically logged out, regardless of activity. After logout, the user is prohibited from logging in again for 15 minutes.
